NewSpark Gaming Terms and Conditions
Welcome to NewSpark Gaming, also known as NewSpark Roleplay ("NewSpark Gaming," "we," "us," or "our"). By accessing or using our FiveM server and related services (the "Services"), you ("User," "you," or "your") agree to comply with and be bound by the following terms and conditions (the "Terms"). If you do not agree with these Terms, you must not use our Services.
Glossary of Terms
User-Generated Content Any photos, documents, media, or other content uploaded, posted, or otherwise transmitted by Users to the Services.
User Content A subset of User-Generated Content, referring specifically to any photos, documents, media, or other content uploaded, posted, or otherwise transmitted by Users to the Services.
User-Provided Assets Any assets provided by Users for use on the Services, including but not limited to scripts, mods, models, and textures.
User Assets A subset of User-Provided Assets, referring specifically to any assets provided by Users for use on the Services.
Character Information Any information, likeness, or other attributes associated with a User's character in the Services.
Services The FiveM server and related services provided by NewSpark Gaming.
Terms These terms and conditions governing the use of the Services.
NewSpark Gaming The entity providing the Services, also known as NewSpark Roleplay.
User Any individual who accesses or uses the Services.
Account The User's registered profile on the Services.
Indemnification The User's agreement to hold NewSpark Gaming harmless from any claims, liabilities, damages, losses, and expenses arising out of the User's use of the Services or violation of these Terms.
Termination The right of NewSpark Gaming to terminate or suspend a User's account and access to the Services.
Superseding Policies Other policies, agreements, or terms that may take precedence over these Terms when expressly agreed upon by NewSpark Gaming and the User.
Illegal Any content or action that violates local, national, or international laws, regulations, or legal standards.
Inappropriate Any content or action that is offensive, harmful, obscene, discriminatory, or otherwise unsuitable for the Services, as determined at the sole discretion of NewSpark Gaming.
1. User-Generated Content
1.1 Ownership and Rights
By uploading, posting, or otherwise transmitting any photos, documents, media, or other content ("User Content") to the Services, you affirm that you have all necessary rights, licenses, and permissions to do so. You agree that such User Content is non-confidential and non-proprietary.
You grant NewSpark Gaming a perpetual, irrevocable, worldwide, royalty-free, and transferable license to use, reproduce, distribute, display, and perform the User Content in connection with the Services.
1.2 Responsibility for User Content
You are solely responsible for the User Content you upload or post on the Services. This includes ensuring that your User Content does not violate any laws, regulations, or third-party rights.
Uploading illegal, harmful, or inappropriate content is strictly prohibited. Any violation of this policy will result in immediate termination of your account and potential legal action. You will be liable for any damages resulting from such violations.
2. User-Provided Assets
2.1 License to Use
By providing any assets (including but not limited to scripts, mods, models, and textures) for use on the Services ("User Assets"), you grant NewSpark Gaming a license to use, reproduce, distribute, display, and perform the User Assets for as long as needed for the operation and improvement of the Services.
2.2 Asset Take-Down Requests
If you wish to request the removal of your User Assets from the Services, you must send a written request to admin@newsparkgaming.live. NewSpark Gaming reserves the right to make the final decision on whether an asset will be removed.
3. Player Character Information and Likeness
3.1 Use of Character Information and Likeness
By creating and using a character in the Services, you grant NewSpark Gaming the right to use, reproduce, distribute, display, and perform any information, likeness, or other attributes associated with your character ("Character Information") for promotional, marketing, or any other purposes related to the Services.
This right is granted on a perpetual, irrevocable, worldwide, royalty-free, and transferable basis.
3.2 Responsibility for Character Information
You are solely responsible for ensuring that your Character Information does not violate any laws, regulations, or third-party rights.
Any inappropriate or illegal use of Character Information will result in immediate termination of your account and potential legal action. You will be liable for any damages resulting from such violations.
4. Termination
NewSpark Gaming reserves the right to terminate or suspend your account and access to the Services at our sole discretion, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
5. Liability and Indemnification
You agree to indemnify and hold harmless NewSpark Gaming, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
6. Changes to Terms
NewSpark Gaming reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Services. Your continued use of the Services after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide and be bound by the modified Terms.
7. Superseding Policies
In the event that other policies, agreements, or terms are expressly agreed upon by NewSpark Gaming and the User, such policies, agreements, or terms will supersede these Terms to the extent of any conflict or inconsistency.
